These are the terms that govern this website. The most important one is near the top: nothing on this site is a promise of rankings, leads, or revenue, and any work we do for you is governed by a separate signed agreement.
Does VIS Mountain guarantee marketing results?
No. Nothing on vismountain.com is a promise of a search ranking, a map pack position, an AI answer citation, a number of leads or an amount of revenue. Search results are produced by systems Google, Microsoft and the AI assistants change without notice, and advertising costs are set by live auctions, so no agency can guarantee a position in either.
What VIS Mountain commits to is the work described in a signed services agreement, honest measurement against agreed metrics, and saying plainly when something is not working. That signed agreement governs any engagement and controls wherever it conflicts with these terms.

What these terms cover
These terms apply to vismountain.com and to the information, tools, and forms we publish on it. By using the site you accept them. They are the operative terms, not a summary of something longer, and questions about them go to hello@vismountain.com.
Two boundaries are worth setting straight away. First, this page governs the website. If you hire VIS Mountain, the work itself is governed by a separate signed services agreement, and that agreement controls wherever the two documents disagree.
Second, the marketing examples, explanations, and figures published anywhere on this site are illustrative. They describe what happened for another business, at another time, in another market. The section that follows sets out in detail what we do and do not promise, because that is the part of an agency's terms that people most often skip and most often need.
No guarantee of marketing results
Nothing published on this website is a promise of a search ranking, a map pack position, an AI answer citation, a volume of leads, a cost per lead, a conversion rate, or an amount of revenue. We do not offer guarantees of that kind, and we would not trust an agency that did.
Search results are produced by systems that Google, Microsoft, and the AI assistants control and change without notice, and that weigh thousands of signals we do not set. Advertising costs are set by live auctions against competitors whose budgets and bids we cannot see. Nobody outside those companies can guarantee a position in them. Outcomes also depend heavily on things that sit outside our control and inside your business: how competitive your market already is, how much budget is committed and for how long, the quality of your offer and your pricing, how quickly your team answers the phone and returns messages, your reviews and your reputation, your opening hours and your service area, and whether the changes we recommend are actually implemented.
What we do commit to is the work itself. We commit to doing what the services agreement says we will do, to measuring it honestly against agreed metrics, to telling you what is working and what is not, and to telling you when we think a channel or a budget is not worth continuing. Where we describe typical outcomes anywhere on this site, treat them as context for a conversation rather than a projection for your account.
Case studies, testimonials, screenshots, and figures published on this site describe what happened for a specific business in a specific market at a specific time. Your result will differ. Past performance in marketing is genuinely not a predictor of future performance.
Accepting these terms

This is a business to business website intended for business owners, marketing managers, and the people who make buying decisions for a company. You must be at least 16 years old to submit information through a form or the chat window.

VIS Mountain and the VIS Mountain logo are our marks. So are the marks of our sub-brands: Branding Signal, Bird Local, Web Engine, and Dash Funnels. You may refer to any of them in ordinary descriptive writing, for example to say that you read something here or that you work with us. You may not use our names or logos as your own, use them in a way that suggests we endorse or are affiliated with your business when we are not, or register a name, domain, or mark that is confusingly similar to any of them.

The services agreement controls the work
Nothing on this website is an offer capable of acceptance, a quote, or a contract for services. Submitting a form, requesting a free audit, or booking a call does not create an engagement and does not oblige either of us to anything.
Work begins only when both sides sign a services agreement, proposal, or order form. That document sets out the scope, the fees, the term, the notice period, ownership of accounts and assets, confidentiality, data protection commitments, and the commercial limits of our liability for the work.
If anything in the signed services agreement conflicts with anything on this page, the services agreement wins for that engagement. This page continues to govern your use of the website itself.
Prices, packages, and inclusions described anywhere on this site may change. The figures that bind us are the ones written into the document you sign.

Indemnity
You agree to defend, indemnify, and hold harmless VIS Mountain Marketing & Advertising and its owners, employees, and contractors from claims, damages, losses, and reasonable legal costs arising out of your breach of these terms, your misuse of this website, your submission of content you were not entitled to submit, or your infringement of someone else's rights through your use of the site.
We will tell you promptly about any claim covered by this section, and we will cooperate reasonably with your defence of it. We reserve the right to take over the defence of a claim at our own expense, and you agree not to settle a claim in a way that imposes an obligation on us without our written agreement.
Governing law and venue
These terms and any dispute arising out of them or out of your use of this website are governed by the laws of the State of Illinois, where our head office sits, without regard to conflict of law rules that would apply the law of another state.
You agree that any claim or proceeding arising out of these terms or your use of this website will be brought in the state or federal courts located in the State of Illinois, and you consent to the jurisdiction of those courts.
If a court decides that any part of these terms is unenforceable, that part is severed and the rest continues to apply. If we do not enforce a provision on one occasion, that is not a waiver of our right to enforce it later.
Changes to these terms, and how to reach us

No, and neither can anyone else. Rankings are produced by systems Google and the AI assistants control and change without notice, and advertising costs are set by live auctions. What we commit to is the work in the services agreement, honest measurement against agreed metrics, and telling you when something is not working.
Do these terms cover the work you do for clients?
No. These terms cover this website. The work is governed by a separate signed services agreement that sets out scope, fees, term, notice, account ownership, confidentiality, and the commercial limits of our liability. Where the two documents disagree, the services agreement controls for that engagement.
Is a free audit a contract?
No. Requesting an audit, submitting a form, or booking a call creates no obligation on either side. There is no fee, no commitment to buy, and no automatic enrolment into anything. An engagement starts only when both sides sign an agreement.
Can I quote or link to something on this site?
